National Limited Warranty of Love’s Truck Solutions, LLC ("LTS")

THIS LIMITED WARRANTY APPLIES ONLY TO RETREADS AND CASINGS SUPPLIED BY LTS IN THE UNITED STATES. CLAIMS MADE UNDER THIS WARRANTY MUST BE MADE AT AN LTS APPROVED LOCATION. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU SHOULD NOT PURCHASE THESE PRODUCTS. READ THE ENTIRE DOCUMENT. THIS DOCUMENT CONTAINS LIMITATIONS ON THE LIABILITY OF LTS AND ITS AFFILIATES AND EXCLUSIONS FROM THE LIMITED WARRANTY PROVIDED HEREIN.

1. General; Scope. This National Limited Warranty (the “Limited Warranty”) is for the exclusive benefit of the original purchaser (the “Customer”), and is not assignable or transferrable. Subject to the terms, conditions and exceptions set forth herein, this Limited Warranty covers defects in workmanship and materials by LTS for the:

Retreads manufactured by LTS and sold to a Customer bearing a valid LTS DOT plant code down to 4/32nds of an inch of tread remaining, excluding the LV product line (the “Retread(s)”),
Casings sold to a Customer with a Retread (whether supplied by LTS or supplied by a Customer and approved by LTS) bearing a valid LTS DOT plant code down to 4/32nds of an inch of tread remaining on the applicable Retread (the “LTS Casing(s)”), and
Repairs conducted by LTS on a LTS Casing (the “Casing Repair(s)”).

The coverage provided by Section 1(a) and (b) shall be referred to as the "Retread & Casing Warranty," and the coverage provided by Section 1(c) shall be referred to as the "Casing Repair Warranty." The Retread & Casing Warranty and Casing Repair Warranty are collectively referred to as the “Limited Warranty.”

2. Retread & Casing Warranty Coverage, Conditions and Adjustments. The Retread & Casing Warranty extends for the life of the Usable Tread on the retread tire only. The “Useable Tread” of a retread tire is the tread located at a depth of 4/32nds and above. If personnel approved by LTS find a Retread or LTS Casing is unserviceable due to a defect in workmanship or materials covered under the Retread & Casing Warranty, then a credit will be provided to be applied to the purchase of a comparable Retread or LTS Casing (as applicable) based upon the following:

If Usable Tread remains:Customer may receive a 100% credit of the purchase price paid for the Retread and LTS Casing if less than 10% of the original Retread has been worn away. When 10% or more of the original Retread has been worn away but Useable Tread remains, the Customer shall be credited on a pro rata basis of the purchase price paid for the Retread and LTS Casing corresponding to the percentage of Usable Tread remaining, based on the original tread depth of the Retread.
For example: Customer purchases a retread tire at retail for $200.00 with 12/32nds of Retread depth. Personnel approved by LTS find the Retread is unserviceable due to a defect in workmanship or materials covered under the Retread & Casing Warranty. 25% of the original Retread depth has been worn away but 9/32nds remains. The Customer would be credited $84.00 toward the purchase of a comparable retread tire. The calculation would be: (9/32nds – 4/32nds) divided by 12/32nds, which equals 42% Useable Tread remaining; then, 42% multiplied by $200.00 equals $84.00 of credit).
If it is not possible to measure whether any Usable Tread remains: Customer may receive a credit of the purchase price paid for the Retread and LTS Casing, or for the Retread only, based on the number of days that have accrued following the DOT Retread production date as follows:

3. Casing Repair Warranty Coverage and Adjustments. The Casing Repair Warranty extends for the life of the LTS Casing, which shall be from the date the original Casing Repair is performed until the time when, in LTS or its affiliates’ sole discretion, the LTS Casing can no longer support a Retread (the "Casing Life"). Only the original Casing Repair performed by LTS is subject to the Casing Repair Warranty; additional repairs are treated separately.

If personnel approved by LTS find during the Casing Life that a Casing Repair has a defect in workmanship or materials, then in LTS’ sole discretion either (a) the Casing Repair will be repaired at no cost to the Customer, (b) a refund will be provided for the cost for such Casing Repair to the Customer; or (c) a credit in an amount equal to the cost of such Casing Repair will be provided to be applied to the purchase of a comparable LTS Casing.

4. Claims; Proof of Purchase Required. Any claims under the terms of this Limited Warranty must be presented at any Love’s Truck Care center or other LTS approved location. This Limited Warranty is not honored at unapproved locations. When making a claim under the terms of this Limited Warranty, a Customer must present the retread tire to any Love’s Truck Care center and must provide proof of purchase in the form of a sales or repair invoice. If no proof of purchase is provided, coverage will be based upon the DOT plant code or DOT repair date and may be denied. A Retread or LTS Casing accepted for coverage becomes the property of LTS. A Retread or LTS Casing which is not eligible for repair or credit under this Limited Warranty may be eligible for repurchase by LTS under its casing repurchase program.

5. Costs Not Included. Regardless of any credit received for a Retread, LTS Casing or Casing Repair covered by this Limited Warranty, the Customer shall be responsible for the cost of mounting, balancing and any other product or service charges and applicable taxes and fees.

6. Exclusions. Any claims under the terms of this Limited Warranty within five (5) years from the DOT Retread production date. This Limited Warranty does not apply to the LV product line. This Limited Warranty does not apply when a Retread or LTS Casing becomes damaged or unserviceable due to the following (the “Exclusions”):

Road hazard injury (including, but not limited to, cut, snag, bruise, impact damage, or puncture);
Improper mounting of the tire, tire/wheel imbalance by a third party;
Improper repair performed by a third party;
Misapplication, improper maintenance, overloading, under-inflation or over-inflation;
Use by Customer for any purpose other than its intended purpose or in other than normal operating conditions, including but not limited to misuse or abuse resulting in damage or fatigue;
Accident, fire, chemical corrosion, contamination, curbing, vandalism, collision, or any items of negligence or abuse;
Mechanical irregularity of the vehicle such as vehicle damage or wheel misalignment resulting in rapid or uneven tread wear;
Intentional alteration of the Products;
The addition of liquid, solid or gaseous material other than gaseous air, nitrogen or carbon dioxide;
Flat spotting caused by improper storage; and
Ozone cracking, ozone checking, weather cracking or weather checking.

7. Limitation of Liability.

THIS LIMITED WARRANTY IS IN LIEU OF, AND LTS HEREBY DISCLAIMS (ON BEHALF OF ITSELF AND ITS AFFILAITES), ANY AND ALL OTHER WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NO OTHER WARRANTY OR REPRESENTATION OF ANY KIND IS MADE BY LTS, ITS EMPLOYEES OR REPRESENTATIVES, OR SHALL BE IMPLIED BY LAW.

IN NO EVENT WILL THE LIABILITY OF LTS, OR ANY OF ITS AFFILIATES, EXCEED THE PAYMENT RECEIVED FROM THE CUSTOMER FOR THE APPLICABLE RETREAD, LTS CASING AND/OR CASING REPAIR. IN NO EVENT SHALL LTS, OR ANY OF ITS AFFILIATES, BE LIABLE HEREUNDER FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOSS OF USE, TIME, BUSINESS, REVENUE OR PROFITS, REGARDLESS OF THE TYPE OF CLAIM BEING IN CONTRACT, TORT OR OTHERWISE.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO THE CUSTOMER WHEN PURCHASING IN SUCH A STATE. THIS LIMITED WARRANTY GIVES THE CUSTOMER SPECIFIC LEGAL RIGHTS, AND THERE MAY BE OTHER AVAILABLE RIGHTS WHICH VARY FROM STATE TO STATE.

8. Exclusive Remedy.

THE CUSTOMER ACKNOWLEDGES THAT THIS LIMITED WARRANTY PROVIDES THE SOLE AND EXCLUSIVE REMEDY AGAINST LTS, AND ITS AFFILIATES, FOR ANY LIABILITY WITH RESPECT TO THE RETREAD, LTS CASING AND/OR CASING REPAIR WHETHER ANY CLAIM FOR RECOVERY IS BASED UPON OR ARISES OUT OF THEORIES OF CONTRACT, TORT (INCLUDING STRICT LIABILITY) OR OTHERWISE PROVIDED THAT THE FOREGOING LIMITATIONS SHALL NOT APPLY FOR ANY LIABILITY WHICH IS NOT ALLOWED TO BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

LV Product Line Only

THIS DOCUMENT CONTAINS LIMITATIONS ON THE LIABILITY OF LTS AND ITS AFFILIATES AND EXCLUSIONS FROM THE LIMITED WARRANTY PROVIDED HEREIN.

Retreads manufactured by LTS in the “LV” product line and sold to a Customer bearing a valid LTS DOT plant code down to 4/32nds of an inch of tread remaining (the “LV Retread(s), and
Casings sold to a Customer with a LV Retread (whether supplied by LTS or supplied by a Customer and approved by LTS) bearing a valid LTS DOT plant code down to 4/32nds of an inch of tread remaining on the applicable LV Retread (the “LTS Casing(s)”).

The coverage provided by Section 1(a) and 1(b) shall be referred to as the “Limited Warranty.”

2. Limited Warranty Coverage, Conditions and Adjustments. The Limited Warranty extends for one (1) year from the date of purchase. If personnel approved by LTS find a LV Retread or LTS Casing is unserviceable due to a defect in workmanship or materials covered under the Limited Warranty, then a credit will be provided to be applied to the purchase of a comparable LV Retread or LTS Casing (as applicable). Such credit will be for 100% of the purchase price paid for the LV Retread and LTS Casing if 4/32nds or more of the tread remains on the original LV Retread at the time of the Customer’s warranty claim.

3. Claims; Proof of Purchase Required. Any claims under the terms of this Limited Warranty must be presented at any Love’s Truck Care center or other LTS approved location. This Limited Warranty is not honored at unapproved locations. When making a claim under the terms of this Limited Warranty, a Customer must present the retread tire to any Love’s Truck Care center and must provide proof of purchase in the form of a sales or repair invoice. If no proof of purchase is provided, coverage will be based upon the DOT plant code or DOT repair date and may be denied. A LV Retread or LTS Casing accepted for coverage becomes the property of LTS. A LTS Casing which is not eligible for repair or credit under this Limited Warranty may be eligible for repurchase by LTS under its casing repurchase program.

IN NO EVENT WILL THE LIABILITY OF LTS, OR ANY OF ITS AFFILIATES, EXCEED THE PAYMENT RECEIVED FROM THE CUSTOMER FOR THE APPLICABLE LV RETREAD AND/OR LTS CASING. IN NO EVENT SHALL LTS, OR ANY OF ITS AFFILIATES, BE LIABLE HEREUNDER FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOSS OF USE, TIME, BUSINESS, REVENUE OR PROFITS, REGARDLESS OF THE TYPE OF CLAIM BEING IN CONTRACT, TORT OR OTHERWISE.

7. Exclusive Remedy.

THE CUSTOMER ACKNOWLEDGES THAT THIS LIMITED WARRANTY PROVIDES THE SOLE AND EXCLUSIVE REMEDY AGAINST LTS, AND ITS AFFILIATES, FOR ANY LIABILITY WITH RESPECT TO THE LV RETREAD AND/OR LTS CASING REPAIR WHETHER ANY CLAIM FOR RECOVERY IS BASED UPON OR ARISES OUT OF THEORIES OF CONTRACT, TORT (INCLUDING STRICT LIABILITY) OR OTHERWISE PROVIDED THAT THE FOREGOING LIMITATIONS SHALL NOT APPLY FOR ANY LIABILITY WHICH IS NOT ALLOWED TO BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
